A multidistrict litigation (MDL) has been established for lawsuits alleging injuries from the Smith & Nephew Birmingham Hip Resurfacing (BHR) metal-on-metal hip implant. MDLs are a type of mass tort used to make complex litigation proceed faster and more efficiently. Lawsuits are consolidated when they share common questions of fact; the U.S. Judicial Panel on Multidistrict Litigation (JPML) transfers these lawsuits to one court before one judge. An MDL moves towards quicker resolution because it eliminates the need for duplicate pretrial processes, such as the discovery phase.

UPDATE: March 15th, 2017 – DePuy ASR SETTLEMENT EXTENDED!

PLEASE BE ADVISED THAT The Round 2 settlement program is extended to cover compensable revisions using the same criteria for revision surgeries that have taken place between January 31st, 2015 and February 15, 2017. Additionally, cases that were eligible to participate in Round 1 or Round 2 remain eligible to participate in this extended settlement program. A separate (but identically administered) EIF program will be implemented for cases enrolling after Feb. 1st, 2017.
